It is commonly understood that it is illegal for an employer to engage in sexually offensive conduct in the workplace. However, it is also illegal to harass employees because of their age, race, or disability. Any harassment, whether based on a person’s sex, race, age, or disability, is prohibited if it is unwelcome and affects a “term, condition, or privilege” of employment. Often, as in cases involving harassment by co-workers, is it also necessary that the person being harassed make a specific complaint to the employer in order to give them a chance to take “remedial action”.
